   First you must “copy write” protect your work. To do that without an lawyer you must mail it to yourself. Then….(NEVER OPEN it. Unless some one tries to say they had the idea first), and then only in a court of law.This way (because of the federal time and date stamp on it) no one can contest the time and date of the Idea.
   Once you have that out of the way,…use it on every thing,…get people used to seeing it on all of your (whatever).

   Get a copyright. There are several ways you can apply for one and you don’t need a lawyer.

   yes, you can. But the attorney is going to do a search and verify that no one else is out there and they are going to be able to argue around anyone else out there using a similar mark. So it is to your advantage to use an attorney, but it is not required.

   If you live in the USA go to http://www.uspto.gov/main/trademarks.htm – all the paperwork you need is there and if you have any questions there are lawyers available for free advice on their 800#. Good Luck!

   AlaskanMan was partially right in his answer. You must send yourself a CERTIFIED LETTER. This is called the “poor man’s copyright”.
